Fairborn Mother Says Daughter Groped at School: District Leaders Say Hands Are Tied

FAIRBORN -- A Fairborn mother says her daughter was continually groped by a teen at Fairborn High School last year.And now that school is getting ready to start, she's worried it'll happen again."One day it was touching her butt one day it was touching her breasts,"said the mother who didn't want to be named to protect her daughter, "Nobody deserves to be violated in this manner. Schools are there to educate, not for your child to be harmed."Fairborn Police say there is an investigation surrounding the incident.The boy could be charged with sexual imposition, which is a misdemeanor."I know that the perpetrator has been given an expulsion," said the mother, "No one will tell me for how long and there's a chance that he can come back."This concerns the mother, but the district says by law, its hands are tied, even in criminal cases."We are a public school and under public school we are to educate all children," said Gary Walker, Director for Student Services at Fairborn City Schools, "If they are convicted and serve their term then they come back to us and they are our student."The only form of security the school can give parents is a safety plan."It could be that they leave class early, leave class late, are taken by another person to class, if it's a sexual predator they don't go to the bathroom at the same time as other kids," said Walker.But for this parent, it's not enough."This needs to be stopped. We'll go to the top until we get this stopped," she said, "As a parent you have to do what you have to do to ensure their safety and that's what I intend to do."District leaders say they cannot permanently expel a student unless there is some violent crime or threat committed on school property.And often times at that point, the police take over the situation.
