YouTube could not exist without a system for identifying and flagging copyright violations. But with a system that not only auto-flags, but auto-claims content that uses copyrighted material, the legality gets a lot grayer and the potential for abuse a lot higher. Is there a way for YouTube to account for fair use? Or is the TOS the judge and jury?
