USCIS has announced  that it is postponing implementation of the recently published Policy Memorandum regarding USCIS’ authority to issue Notices to Appear.

00:13 An NTA is a charging document, essentially allows the government to play somebody in removal proceedings and typically those Notice to Appear are issued to people that are currently here without status or under the old policy, people that actually committed certain violations.

01:06 it's basically almost a zero tolerance policy, which says that if a person is in the United States and received an application, a denial on an application from the moment that person is denied and NTA could be issued and putting this person in removal proceedings.

When the Policy Memorandum was issued last month, each USCIS Service Center had been given 30 days to develop processes and procedures for NTA issuance, even though the guidance itself took effect immediately. As of July 30, 2018, the operational guidance for implementation of the NTA policy has not been completed. Because of this, USCIS is postponing implementation of the NTA memo until operational guidance is issued. We do not have any information regarding when the operational guidance will be issued or when the NTA memo we be implemented going forward.
