Sentencing Kids: Violent Juvenile Crime and the Law In 2005 the Supreme Court held that the 8th Amendment bars the death penalty for minors, and in 2010 it extended that reasoning to hold that sentences of life without parole for minors convicted of non-homicide crimes also are unconstitutional. Last month, the Court heard argument on the next question: Does the 8th Amendment prohibit life without parole for minors convicted of murder?
