HC RAPS BICHOLIM MAMLATDAR FOR ASSESSING LESS COMPENSATION TO FARMER FOR CROP LOSS DUE TO MINING

The High Court has rapped the Mamlatdar of Bicholim Taluka for assessing unrealistically less compensation for crop loss occurred in 14 years due to mining to the petitioner farmer. The High Court has directed the Chief Secretary to take necessary steps including disciplinary proceedings against the Mamlatdar for not disposing petitioner farmer's compensation claim within stipulated time of 6 months. The High Court also directed Goa government to appoint a Surveyor from Indian Council Agricultural Research at Old Goa to assess the crop loss in question and submit report on next date of hearing. In 2001, some farmers of Sattari taluka had approached the High Court pointing out farming loss due to mining in that area. After hearing the petitioner farmers and respondent authorities, the High Court in its order dated 18th July, 2003 directed that Mamlatdar of the Taluka to specifically deal with complaints of damages to agricultural land and crop loss due to the mining activities Concerned Mamlatdar to dispose of the compensation claim applications within 6 months from the date they are registered Chief Secretary of Goa to take steps including disciplinary proceedings against the Mamlatdar if there was a failure to abide by the order Present petitioner farmer in the year 2014 had made an application before the Mamlatdar of Bicholim Taluka for payment of compensation in respect to damages to his 5 agricultural properties in Shirgao due to mining. The Mamlatdar did not decide his compensation application within the stipulated time of 6 months and the petitioner farmer filed his petition before the High Court. Later, on 8 February 2018, the Mamlatdar disposed of his compensation application and ordered the concerned authorities to pay the applicant farmer 6,975 as compensation for 14 years for his all 5 agricultural properties. The Mamlatdar ignored the report of the Zonal Agricultural Officer, Bicholim, who had recommended fixing the compensation of 6975 per year.
