LOUISVILLE, Ky (WKRC) -- A Kentucky judge rules that a woman must testify against her same sex partner. Bobbie Joe Clary is accused of murder.  The prosecutor says her partner, Geneva Case, heard Clary admit to the crime. But case has refused to testify.  She cites spousal privilege, which is used to keep husbands and wives from testifying against each other. The two entered a civil union in Vermont several years ago but, the judge today said Kentucky does not recognize same sex marriages therefore she must testify.
