Proposed legislation in New York State moves to give police increased police powers by providing them with the Textalyzer. The Textalyzer would allow police to determine if drivers were using their phone in a post-crash situation. And like the breathalyzer, drivers would be subject to same police powers and penalties. The proposed legislation faces opposition from the 4th Amendment in the United States and people’s right to privacy. Still, drivers using their phones while driving has reached epidemic levels in North America and other parts of the world. And governments are moving to mediate the fundamental conflict between right to privacy and their mandate to uphold public safety.
