What is the alleged onset date in your Social Security case? Onset refers to the date when you contend that you became disabled and unable to perform the duties of a simple, entry-level job.

Usually the best choice for an onset date is the day you stopped working full time because of your medical or mental health impairments. Sometimes, however, the onset date associated with your file may be different and needs to be changed.

Sometimes, the clerk from Social Security who takes your information simply chooses a date. Perhaps you chose a date 20 years ago when you first started experiencing symptoms. Or perhaps you chose the date you lost your job because your company closed down.

As I discuss in this video, the appropriate date for the onset of your disability is the date when your medical condition left you unable to work full time. More specifically, you should choose a date that is also supported by the evidence.

Sometimes during a hearing, the judge will say something like this to you and your attorney: "I am prepared to find you disabled, but the evidence supports a different onset date. Will you agree to amend your onset date?"

Most of the time, you should consider the judge's offer - it is difficult under any circumstances to win approval of your disability claim and if a judge is prepared to find in your favor, that is a good thing. Sometimes, however, you and your attorney may feel that the evidence supports an earlier onset date and you can turn down the judge's offer. Either way, you and your lawyer should talk about the onset date in your case and discuss how you might proceed if the judge proposes a change to that date. #onsetdate #amendedonsetdate #filefordisability
