Ceres Police Officer Involved Fatal Shooting - Update Interview

Last month an off duty police officer with the Ceres Police Department shot and killed a man in the park next to Beyer High School in Modesto, California.

A criminal investigation is now underway so we headed out to talk with Modesto Police Department Public Information Officer Heather Graves about the investigation.

Here is a press release explaining more from the Modesto Police Department:

On March 29th at about 10:21 PM, officers responded to a 911 call of a shooting at Beyer Park in Northeast Modesto. When they arrived, they found off-duty Ceres Police officer, Thomas Miller, providing CPR to 29-year-old Jason Moland who had been shot. 

The preliminary investigation indicates that Miller and his female acquaintance Rosio Moland were at the park when they were confronted by Jason Moland. Moland pointed a gun at Miller. Miller discharged his firearm, striking Moland. Moland was rushed to a local hospital where he died from his injuries. 

The gun Moland pointed at Miller was later determined to be a Pellet gun. While the events leading up to the shooting are still under investigation, detectives believe the confrontation ensued as a result of Moland’s suspicions of an evolving relationship by Rosio outside their marriage. 

Miller, who has one year of service with the Ceres Police Department, was placed on standard paid administrative leave. 

During this investigation, detectives have determined Jason Moland had no criminal history and was an 8-year employee of Winco Foods as a Loss Prevention Officer. Moland was also a prior Modesto Police Explorer and was seeking full-time employment as a Law Enforcement Officer. 

Three separate and independent investigations have been launched into this incident, which is standard protocol for any officer-involved shooting investigation in Stanislaus County. The Modesto Police Department will be conducting the criminal investigation, the Stanislaus County District Attorney’s Office will be conducting an independent review of the incident and the Ceres Police Department’s Internal Affairs Unit will be conducting an administrative investigation into the circumstances surrounding the shooting.
