Hearing Scheduled to Decide on Plains Southcap

MOBILE, Ala. (WPMI) A hearing will be held Monday to decide whether to grant condemnation for Plains Southcap.In November Circuit Judge Robert Smith ruled in favor of Plains Southcap in its ongoing legal battle with MAWSS.Smith stated that regardless of whether its an LLC or a corporation it has the legal right to move forward in its fight to condemn MAWSS property for construction of an oil pipeline through the Big Creek Lake Water Shed. Previously Probate Judge Don Davis ruled that Plains did not have legal right to condemn the land because it was an LLC.
